1. Purpose
These Terms and Conditions govern the use of the Motium mobile application and related services.
Using the Service implies full acceptance of these Terms and Conditions.

3. Service description
Motium is a professional mobility tracking mobile application that allows:
- Automatic and manual recording of business trips
- Mileage reimbursement calculations based on the applicable tax scale
- Professional expense management with OCR
- PDF and Excel data exports
- Data synchronization across multiple devices
- Data sharing with a business account (Pro)
4. Offers and pricing
4.1 Trial period
Every new user benefits from a free 14-day trial with access to all Premium features.
4.2 Premium individual subscription
- Monthly: €4.99 incl. VAT / month, cancellable at any time
- Lifetime: €120.00 incl. VAT, one-time payment with permanent access
4.3 Pro license (businesses)
- Monthly: €6.00 incl. VAT / license / month
- Lifetime: €144.00 incl. VAT / license, one-time payment
4.4 Payment terms
Payments are made by credit card through the secure Stripe platform. The monthly subscription renews automatically.
5. Right of withdrawal
Article L221-28 of the French Consumer Code
The right of withdrawal cannot be exercised for contracts involving digital content not supplied on a physical medium once performance has begun after the consumer expressly agreed and waived this right.
5.1 Waiver of the right of withdrawal
By subscribing to Motium Premium with immediate access, you acknowledge that you:
- Expressly requested that the service start immediately after payment without waiting for the 14-day withdrawal period to expire
- Expressly waive your 14-day withdrawal right under Article L221-28 of the French Consumer Code as soon as you gain access to the Premium service
5.2 Consent collection
This waiver is collected explicitly before any payment using two separate unchecked checkboxes. No payment can be made without this double explicit consent.
5.3 Subscription cancellation
You can cancel your monthly subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refund will be granted.
6. Termination
6.1 Termination by the user
The user may cancel the monthly subscription at any time:
- From the Motium app settings
- From the Google Play Store (Subscriptions)
Termination takes effect at the end of the current billing period.
6.2 Termination by Motium
Motium reserves the right to suspend or terminate access to the Service in the event of:
- Non-compliance with these Terms and Conditions
- Fraudulent use of the Service
- Payment default
7. Use of the service
The user agrees to:
- Provide accurate information
- Not use the Service for illegal purposes
- Not attempt to bypass security measures
- Not resell or redistribute the Service
8. Intellectual property
The Motium application and all of its elements (brand, logo, source code, design, content) are protected by intellectual property rights. Any unauthorized reproduction, modification, or use is prohibited.
9. Liability
9.1 Motium commitments
Motium undertakes to provide the Service diligently and to ensure service availability, excluding scheduled maintenance.
9.2 Limitations
Motium cannot be held liable for:
- Temporary interruptions for maintenance
- Calculation errors caused by incorrect data entered by the user
- The way exported data is used by the user
- Tax consequences of the user’s declarations
- Malfunctions related to the user’s device
9.3 Force majeure
Motium cannot be held liable in cases of force majeure (natural disaster, war, strike, widespread internet outage, etc.).

12. Changes to the terms
Motium reserves the right to amend these Terms and Conditions at any time. Users will be informed of any significant change by email or in-app notification. Continued use of the Service after a change means acceptance of the new terms.
13. Governing law and disputes
These Terms and Conditions are governed by French law.
In the event of a dispute, an amicable solution will be sought before legal action. Consumers may use a consumer mediator free of charge.
Failing amicable settlement, French courts shall have jurisdiction.
14. Mediation
In accordance with Article L612-1 of the French Consumer Code, consumers may use a consumer mediator in the event of a dispute.
